Terms and Privacy

 I. Definitions used in the following document:

  1. Online Shop (Shop) – internet service available by knittons.com, through which the customer can order and purchase selected goods.
  2. Seller – Petro Kiryanov Spólka Komandytowa.
  3. Customer – an individual, legal entity or organizational unit that is not a legal entity, who places an Order on Online Shop.
  4. Goods – products presented at Knittons.com Online Shop
  5. Order – statement of the preference of customer in accordance with the Sales Agreement, specifying, in particular, the type, price and quantity of product.
  6. Terms and Conditions – Terms and Conditions of using online Services on knittons.com online store
    Civil Code (Kodeks Cywilny) – Act of 23 April 1964 (Dz.U. Nr 16, poz.93 ze zm.).
  7. Sales Agreement – is a legal contract that obligates a customer to buy and a seller to sell a product or service within limits of the Civil Code, concluded between Petro Kiryanov S.K. and the Customer, using the website knittons.com.
  8. Law on special terms of consumer sale – Law of 27 July 2002 on special conditions of consumer sale and on changes to the Civil Code (Dz.U. Nr 141, poz. 1176 ze zm.);
    Electronic Services Act – Act of 18 July 2002 on providing services by electronic means (Dz. U. Nr 144, poz. 1204 ze zm.);
  9. These Regulations are the regulations referred to, in art. 8 of the Electronic Services Act.Online Shop (Shop) – internet service available by knittons.com, through which the customer can order and buy the selected goods. 

 

II. General information

  1. Online Shop knittons.com is a property of Petro Kiryanov S.K., ul. Związkowa, 23 20-148 Lublin, Poland. REGON – 363951518 NIP – 7123309810, KRS – 0000606367 Contact: tel. +48884390149 e-mail: p.kiryanov@knittons.com.
  2. Information about goods provided on the webpage of the Store, in particular their description, technical characteristics and prices creates an opportunity to conduct a contract within the Article 71 of the Civil Code.
  3. Product prices displayed on knittons.com are gross (including VAT), in Polish zloty and do not include shipping costs, which are determined after choosing the right method of delivery. Delivery price will be shown in the checkout process.
  4. The seller reserves the right to change the prices of the goods on knittons.com, to add new goods to the Shop, to carry out promotional campaigns on the store’s website or to make changes to them.
  5. According to the applicable law Petro Kiryanov S.K. reserves the right to provide limited services to users under the age of 18. In this case, potential customers will be notified.
  6. Petro Kiryanov S.K. reserves all the rights and owns full copyright for product images, graphics, logos, visual and intellectual content used on our website. Their copying, converting, distribution, publication and use for sale, is prohibited and punishable by criminal penalties. Petro Kiryanov S.K. does not allow its use; accept written confirmation, in order to avoid copyright violation and thievery of intellectual property.

 

III. Terms of Use and protection of personal data

  1. Registration in the Store is obligatory for fulfillment the sales agreement. Registration is available on the Online Store by accomplishing the registration form. The condition of registration is to agree the terms of the Regulations and to provide personal information marked as mandatory. I agree to send personal information electronically to Petro Kiryanov S.K. Based in Lublin pursuant to the Act of 18 July 2002 on providing services by electronic means (Dz.U. 2002 r. Nr 144, poz. 1204 z pózn. zm.).
  2. Personal information provided to us by Customers is a minimum required for the sale of goods and uses only for conclusion of the contract and in case the Customer agrees to receive information on new products, services, and promotions offered by knittons.com.
  3. Personal data is not shared with third parties for any purposes.
  4. Each customer has the right to access his / her data and to correct/remove it from the database – at knittons.com. Personal data, provided to us are stored and protected in accordance with the applicable law.

 

IV. Procedure for purchasing and entering into a contract for the sale of Goods

  1. In order to enter the Sale Agreement via the Online Shop, you must visit the knittons.com website, select your product, color and size, take further technical steps based on the displayed customer messages and information available on the webpage.
  2. The customer makes a choice of product by adding them into the cart.
  3. During online shopping, the Customer may add/delete Goods or change their quantity in shopping cart.
  4. The summary of the cart will contain information about ordered products, price, the delivery method and delivery cost.
  5. Once the Customer has provided all the necessary data via Internet Store, a summary of the order will appear on the display.
  6. In order to make a purchase, it is necessary to provide personal information marked as necessary, accept the content of the Regulations, make payment via webpage provided by payment system.
  7. Payment at knittons.com can be made through PayPal, PayU, or the bank transfer.
  8. All contract details will be displayed, when payment has been made via PayPal or PayU.
  9. When selecting the payment through the bank transfer, the Customer will be provided with the Seller’s bank account details. The customer has to make the payment through his/her own banking service.
  10. By pushing the “Place an Order” button, the customer makes a statement to conclude a sales agreement with Petro Kiryanov S.K., in accordance with the Terms and Conditions.
  11. The Customer, upon pressing “Place an Order”, concludes the contract in the moment of payment.
  12. The sales contract concluded in English in accordance with the Regulations.
  13. The agreement will not be concluded and the Order will not be placed in case of inaccurate contact details and in case Customer has an attempt to commit fraud, break shop security (hacking), use someone else’s Login or Password.
  14. In case the customer fails to make payment within 5 working days since the agreement, the contract will be considered invalid.
  15. The seller is providing proof of purchase / VAT invoice, which is a confirmation of the Sale Agreement that also will be provided on the customer’s account webpage in online store. In case VAT invoice is necessary, customer has to provide the exact details to issue an invoice properly.

 

V. Protection of personal data

  1. Personal information provided by knittons.com Customers contains the minimum necessary for sale of goods. It is required exceptionally to secure the contract and in case the Customer agrees to get information about new products, services and promotions offered by knittons.com.
  2. We use SSL (Secure Socket Layer) for data confidentiality. SSL is a secure, encrypted transfer between client and knittons.com. SSL helps to save from data capture and limits access to customer’s name, address, phone number or email address.
  3. Personal data is not shared with third parties for any purposes.
  4. Each customer has the right to access his / her data and to correct/remove it from the database – at knittons.com. Personal data, provided to us are stored and protected in accordance with the applicable law.

 

VI. Supply

  1. Products ordered through online shop knittons.com are delivered via Inpost Postmats, Poczta Polska Post or DPD, TNT, DHL courier’s services. There is an option of personal pick up in the local office in Poland, Lodz, 15 J. Zubrowej st.
  2. The shipping time estimates by the order time and delivery time, depending on the delivery service chosen. The order is usually completed within 24 hours (workweek) after order was confirmed and the payment was received on the account.
  3. The order will be sent to the address given by the customer in the shipping form. The option of an order being shipped to another address must be selected after the order has been verified. Orders without complete contact details or in case of inaccurate data provided will not be placed.
  4. The fiscal receipt (or Customer’s request VAT invoice) is attached to the shipment, which is the guarantee document, necessary for the return, exchange or complaint. In the absence of any of these documents, Customer has to report this fact.
  5. Shipping costs are visible during order process.
  6. The company is not responsible for any delays caused by incorrect work of Polish Post-office or any courier companies.

 

VII. Exchange of goods

  1. The customer can replace the item purchased at knittons.com within 14 days of the delivery. The product may be returned if it is not used, remains in the original packaging and has not damaged in any way. The request for goods to be returned shall be sent to customercare@knittons.com email address, with invoice or VAT. Customer carries any costs of returning the goods as well as shipping costs. In case the replacement is a result of our fault, Petro Kiryanov S.K., including the shipping, covers the costs.
  2. In case of difference in price of the returning goods, the customer is obliged to pay the appropriate amount to the bank account of the company. When the item is exchanged to cheaper one, we will refund the difference only to the bank account specified by Customer.

VIII. Support Request

  1. The only effective way to file a statement is to fill out a request form. And send it to customercare@knittons.com.
  2. If the item you received has technical defects, you must inform us to us by emailing customercare@knittons.com or by phone at 884390149 with your receipt or invoice no later than 14 days from the date of delivery.
  3. The cost of the returning goods is not refundable and therefore we do not accept any shipments sent at the cost of the addressee.
  4. The goods are accepted to exchange for identical or other item agreed with the Customer. In this case, knittons.com shop will cover the cost of shipping the suitable item to the customer.
  5. The complaint will be processed within 10 working days after Customer filed it.
  6. The shipment with the complained goods should include a detailed description of the complaint and a return address with the contact phone number.
  7. Complaints shall not be subject to any accidental or intentional mechanical damage (tears, cuts, etc.) and damage caused by improper use.
  8. Returned goods must be clean. Otherwise, we reserve the right to refuse accepting your complaint.

 

IX. Return

  1. The customer may send back the goods purchased in our store without giving a reason within 30 days after delivery. The product may be returned if it is not used, remains in the original packaging and has not damaged in any way.
  2. Returned goods must be returned together with a fiscal receipt or invoice. The shop guarantees a refund of the amount equal to the price of ordered products. Money will be returned within 14 working days, only via bank transfer to the Customer account. The shipping cost of the goods is non-refundable; therefore we do not accept any shipments sent to us at the expense of the company.
  3. The amount for returned goods will be send only to the Customer’s bank account.The customer may send back the goods purchased in our store without giving a reason within 30 days after delivery. This is only possible if the product has not been used, remains in its original packaging and has not been damaged in any way.
  4. Returned goods must be returned together with a fiscal receipt or invoice. The shop guarantees a refund of the amount equal to the price of ordered products. Money will be paid within 14 business days, only by bank transfer to the account indicated by the Customer. The shippng cost of the goods is non-refundable, therefore we do not accept any shipments sent to us at the expense of the company.
  5. The amount due for returned goods is only sent to the bank account indicated by the Customer.
  6. In case the returned item has been shipped at the Seller’s expense (free shipping or other promotion), the refundable amount will be reduced from shipping costs.

 

This Regulation shall enter into force on the date of its placing on the internet shop at knittons.com and shall remain in force for an indefinite period. The Store reserves the right to change this Regulation. Any changes will be effective of the date they are published in online store, so the customer is obliged to verify his / her current review.
